Terms of Service

Welcome to Luxxe Interiors! These Terms of Service ("Terms") govern your use of our interior design services, website (luxxeinteriors.com.au), and any related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Services

Luxxe Interiors provides interior design services, including but not limited to consultations, space planning, concept development, mood boards, 3D renderings, material and furniture selection, procurement assistance, and project coordination. The specific scope of services for your project will be detailed in a separate Service Agreement or proposal.

2. Client Responsibilities

To ensure a successful project, you agree to:

• Provide accurate and complete information about your project requirements, budget, and preferences.
• Provide timely access to the property or site as required for design and implementation.
• Communicate promptly and provide feedback throughout the design process.
• Make timely decisions regarding selections and approvals.
• Secure any necessary permits or approvals from building management, homeowner associations, or local authorities, unless otherwise agreed in writing.

3. Fees and Payment

Fees for our Services will be outlined in your Service Agreement or proposal. Payment terms, including deposit requirements and payment schedules, will also be specified. Payments are due as per the agreed schedule. Late payments may incur interest charges or result in a pause in services.

All purchases of goods or services facilitated by Luxxe Interiors on your behalf (e.g., furniture, fixtures, materials) will be subject to separate invoicing and payment, typically requiring payment in full before orders are placed.

4. Intellectual Property

All design concepts, drawings, plans, specifications, mood boards, 3D renderings, and other creative work produced by Luxxe Interiors (collectively, "Design Materials") are the intellectual property of Luxxe Interiors. Upon full payment of all fees, Luxxe Interiors grants you a non-exclusive, non-transferable license to use the Design Materials for the specific project for which they were created.

You may not reproduce, modify, distribute, or use the Design Materials for any other project or purpose without the prior written consent of Luxxe Interiors. Luxxe Interiors retains the right to use photographs or representations of the completed project for marketing, promotional, and portfolio purposes, unless otherwise agreed in writing.

5. Third-Party Contractors and Suppliers

Luxxe Interiors may recommend or engage third-party contractors, artisans, or suppliers (e.g., builders, painters, electricians, furniture vendors). While we strive to work with reputable professionals, Luxxe Interiors is not responsible for the performance, quality of work, or contractual obligations of these third parties. Your relationship with such third parties will be governed by your direct agreements with them.

6. Changes and Revisions

We understand that design is an iterative process. A reasonable number of revisions are typically included within the initial scope of services, as outlined in your Service Agreement. Significant changes to the project scope, extensive revisions requested after approvals, or changes due to unforeseen circumstances may result in additional fees and adjustments to the project timeline. All such changes will be discussed and agreed upon in writing via a change order or addendum.

7. Delays

Luxxe Interiors will make reasonable efforts to meet project timelines. However, we are not responsible for delays caused by factors beyond our control, including but not limited to:

• Client-caused delays (e.g., late decisions, changes in scope).
• Delays from third-party contractors or suppliers.
• Shipping and manufacturing delays for products.
• Unforeseen site conditions.
• Force majeure events (e.g., natural disasters, pandemics).

8. Limitation of Liability

To the maximum extent permitted by law, Luxxe Interiors's liability for any claim, loss, or damage arising out of or relating to our Services or these Terms shall be limited to the total fees paid by you to Luxxe Interiors for the specific services giving rise to the claim.Luxxe Interiors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use.

9. Termination

Either party may terminate the Service Agreement with written notice if the other party breaches a material term of these Terms or the Service Agreement and fails to cure such breach within a reasonable timeframe (e.g., 14 days) after receiving written notice. Upon termination, you will be responsible for payment for all services performed and expenses incurred by Luxxe Interiors up to the date of termination.

10. Governing Law

These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of QLD, Australia, without regard to its conflict of law principles.

11. Dispute Resolution

Any disputes arising from these Terms or our Services shall first be attempted to be resolved through good-faith negotiation between the parties. If a resolution cannot be reached, the parties agree to pursue mediation before initiating any legal proceedings.

12. Amendments

Luxxe Interiors reserves the right to modify or update these Terms at any time. We will notify you of any significant changes by posting the new Terms on our website or by other means of communication. Your continued use of our Services after such changes constitutes your acceptance of the new Terms.
